Company and legal information

The supplier disclosures we are required to publish under South African law, set out item by item so they can be checked against the statute.

Section 43(1) of the Electronic Communications and Transactions Act 25 of 2002 (the ECT Act) requires a supplier offering goods or services for sale, for hire or for exchange by way of an electronic transaction to make certain information available to consumers on the website where the offer is made. This page consolidates that information for Big Sky Investments in one place, in the order the section lists it, with the statutory letter shown against each item.

Where an item does not apply to us, or where the underlying document does not yet exist, the item says so in plain terms rather than being left out. Nothing on this page is a placeholder for a number or a name we cannot yet prove.

Disclosures under section 43(1) of the ECT Act

(a) Full name and legal status
Big Sky Investments. That is the business name we operate under and the name we trade under; we do not use any other name. Our legal status and company registration particulars are not currently published on this website. If you require them for a transaction or for service of process, request them at info@bigskyfinancials.trade. See item (f) below.
(b) Physical address and telephone number
121 Beyers Naudé Drive, Roosevelt Park, Johannesburg, 2195, South Africa.
No public telephone line; written enquiries by email. We answer within one business day during business hours (Monday to Friday, 08:00–17:00 SAST). We would rather publish no number than publish one that is not answered.

(d) Membership of self-regulatory or accreditation bodies
None. We are not a member of any self-regulatory body or accreditation scheme, we hold no industry accreditation, and we claim no partnership, certification or other relationship with any advertising platform, including Google LLC and Google Ireland Limited.
(e) Code of conduct subscribed to
None. We do not subscribe to an industry code of conduct. We do operate every account under the published policies of the advertising platform it runs on, including the Google Ads policies, and our own standing rules for third-party account access are set out in our third-party advertising policy.
(f) Registration number, names of office bearers, and place of registration
Our company registration particulars are not currently published on this website. If you require them for a transaction or for service of process, request them at info@bigskyfinancials.trade.
(g) Physical address for service of legal documents
Legal documents must be served at 121 Beyers Naudé Drive, Roosevelt Park, Johannesburg, 2195, South Africa. This address is our address for service (domicilium citandi et executandi) and is the same as the physical address in item (b).
(h) Description of the services offered
We are a marketing agency. We plan, build and manage Google Ads campaigns on behalf of client advertisers, and we provide paid social advertising, conversion tracking and analytics, and search engine optimisation. The services are described in full on our services page. We do not sell goods through this website and there is no online checkout on it; engagements are agreed in writing before any work begins.
(i) Manner of payment
By invoice, settled by electronic funds transfer to the bank account shown on the invoice. We do not accept payment card details, we do not take payments through this website, and no payment instrument is stored by us.
(j) Price basis
Our fee is the service fee agreed in the Service Agreement for the engagement; there is no standard price list published on this website, because scope differs by client. Media cost is separate: it is passed through at the exact amount charged by the advertising platform, exclusive of our fees, and it is not marked up. Every invoice shows the service fee and any pass-through amount as separate lines, in the currency stated in the Service Agreement.
(k) Terms of agreement
The general terms on which we contract are published at terms of service. They are read together with the signed Service Agreement for the engagement, which records scope, fees, cadence and duration. Where the two differ, the Service Agreement governs the engagement it relates to.
(l) Time within which the services will be rendered
As set out in the Service Agreement. Management services are rendered continuously for the term recorded there, from the agreed start date; project work is rendered against the timeline recorded in the same document. We do not commit to a delivery date on this page, because no engagement exists until the Service Agreement is signed.
(m) Access to a full record of the transaction
Invoices, statements, campaign reports and the signed Service Agreement are supplied to the client by email, so a copy sits in the client’s own mailbox from the day it is issued. A client may request a further copy at any time by writing to info@bigskyfinancials.trade. On our side, invoices are retained for 5 years, as required by South African tax law, and other client records for the duration of the engagement plus 90 days, as set out in our privacy policy.
(n) Right to withdraw — cooling-off
Section 44 of the ECT Act gives a consumer a seven-day right to cancel certain electronic transactions without reason and without penalty. That right does not apply to services which began, with the consumer’s consent, before the end of the seven-day period, and our engagements ordinarily begin on the client’s written instruction to start work. The right also applies to consumers rather than to businesses, and our clients are ordinarily businesses. Cancellation of an engagement is therefore governed by the notice provisions in our terms of service and in the Service Agreement.
(o) Refund policy
Fees for work already performed are not refundable. Where a client has paid in advance for work that has not yet been performed at the date the engagement ends, the unearned portion is refunded to the account it was paid from, calculated to the effective date of cancellation. Media that has already been spent on an advertising platform cannot be refunded by us, because that money has been paid to the platform and not to us; any refund of unspent media held on a platform account is a matter between the account holder and the platform. Where a cooling-off right does apply under section 44 of the ECT Act, we honour it in full.
(p) Security procedures and privacy policy
We do not process payments on this website and hold no card data. Personal information is processed under the Protection of Personal Information Act, 2013 (POPIA), and our privacy policy sets out what we collect, why, how long we keep it and the security measures applied to it. This website is served over HTTPS, access to client advertising accounts is granted through each platform’s own permission system rather than by sharing passwords, and access is removed when an engagement ends.
(q) Alternative dispute resolution
None subscribed. Disputes are governed by clause 17 (Governing law and jurisdiction) of our Terms of Service and by the South African courts.
(r) Complaints
Complaints about our services, our invoices or our handling of personal information should be sent to info@bigskyfinancials.trade, marked for the attention of The Information Officer where the complaint concerns personal information. We acknowledge within one business day and respond in writing. If the complaint concerns personal information and you are not satisfied with our response, you may complain to the Information Regulator (South Africa) — see complaints and the Information Regulator below for the full details and the time limit that applies.

Business name and registration particulars

Big Sky Investments is the business name we operate under. It is published in the header and in the footer of every page of this website, and it is the name that appears on our invoices, agreements and email correspondence. It is also the name we trade under, so there is no other name under which we do business.

Financial services

Our business name and the domain this website runs on both read as though this were a financial services business. It is not.

Big Sky Investments provides marketing and advertising services only. We do not provide financial, investment or trading advice, and we are not an authorised financial services provider in terms of the Financial Advisory and Intermediary Services Act, 2002.

What we sell is marketing work — campaign management, measurement and reporting — billed as a service fee under a written Service Agreement. Nothing on this website is an offer of a financial product, an invitation to invest, or advice about either.

Complaints and the Information Regulator

Complain to us first, at info@bigskyfinancials.trade. Set out what happened, what you would like us to do about it, and any reference from earlier correspondence. We acknowledge within one business day during business hours (Monday to Friday, 08:00–17:00 SAST) and reply in writing. Complaints about personal information are handled by The Information Officer, who is contactable at the same address.

You do not have to come to us first. If your complaint concerns the processing of personal information, you have the right at any time to lodge a complaint with the Information Regulator, established in terms of section 39 of POPIA. A complaint is lodged on Form 5, which the Regulator publishes. The Regulator will not accept a complaint lodged more than three years after the incident complained of.
